Terms & Conditions

1. Introduction

These Affiliate Programme Terms & Conditions ("Terms") govern your participation in the TheHairxcential Limited Affiliate Programme ("Affiliate Programme").

TheHairxcential Limited, company number 16594857, is referred to in these Terms as "TheHairxcential", "we", "us" or "our".

By applying for or participating in the Affiliate Programme, you confirm that you have read, understood and agreed to these Terms.

2. Eligibility

To participate in the Affiliate Programme, you must meet the requirements determined by TheHairxcential Limited.

• You must provide accurate and complete information when applying.
• You must comply with applicable laws and regulations.
• You must use your affiliate account honestly and responsibly.
• You must not engage in fraudulent, deceptive or misleading activity.
• You must receive approval before participating as an affiliate.

3. Application & Approval

Applicants must complete the affiliate application form and provide the information requested by TheHairxcential Limited.

Submitting an application does not guarantee acceptance into the Affiliate Programme.

TheHairxcential Limited reserves the right to review, approve or reject an application at its discretion.

Once approved, an affiliate may receive access to the affiliate dashboard and available affiliate tools.

4. Affiliate Account

Each approved affiliate is responsible for keeping their account information accurate and up to date.

Affiliates must not share their account credentials with another person or allow another person to use their affiliate account.

Affiliates are responsible for activity conducted through their account.

5. Affiliate Links

Approved affiliates may receive a unique affiliate or referral link through the affiliate dashboard.

Affiliate links are provided for the purpose of legitimately referring customers to TheHairxcential products and website.

Affiliates must not manipulate clicks, referrals, tracking information or commission attribution.

Affiliates must not create misleading pages or communications that falsely suggest they are TheHairxcential Limited or an official employee, representative or agent of the company.

6. Commission

Commission is calculated based on qualifying sales attributed through the Affiliate Programme's tracking system.

Commission is not guaranteed on every transaction.

TheHairxcential Limited reserves the right to determine whether a transaction qualifies for commission in accordance with these Terms and the applicable Affiliate Programme rules.

7. Minimum Withdrawal

Pending commissions do not count towards the minimum withdrawal threshold until they become confirmed and available for withdrawal.

Commissions may remain pending while orders are being processed and while applicable return, cancellation or refund periods are being considered.

TheHairxcential Limited may delay a withdrawal where a transaction is subject to verification, refund, chargeback, cancellation, fraud review or another legitimate dispute.

8. Promotional Rules

Affiliates may promote TheHairxcential through appropriate channels, including social media, websites, content platforms and other lawful promotional channels.

Affiliates must promote TheHairxcential honestly and transparently.

Affiliates must not:

• Make false, misleading or deceptive claims.
• Make unsupported claims about products.
• Engage in fraudulent clicks, impressions or transactions.
• Use spam or unsolicited bulk promotional messages.
• Manipulate affiliate tracking or attribution.
• Misrepresent themselves as TheHairxcential Limited.
• Use TheHairxcential branding in a misleading manner.
• Engage in activity that could damage the reputation of TheHairxcential Limited.

9. Qualifying Orders

A qualifying order is an eligible purchase that is successfully attributed to an approved affiliate through the Affiliate Programme tracking system.

TheHairxcential Limited may exclude transactions that are cancelled, fraudulent, duplicated, refunded, returned, disputed or otherwise deemed ineligible under the Affiliate Programme.

10. Returns, Refunds & Cancellations

Where a customer returns a product, receives a refund, cancels an order or otherwise reverses a qualifying transaction, the related affiliate commission may be reversed or deducted from the affiliate's commission balance.

If commission has already been paid in relation to a transaction that is subsequently refunded or reversed, TheHairxcential Limited may deduct the corresponding amount from future commissions or otherwise seek recovery where legally permitted.

11. Payments

Payments will be made using the payment methods made available by TheHairxcential Limited.

Affiliates are responsible for providing accurate payment details.

TheHairxcential Limited is not responsible for payment delays resulting from incorrect or incomplete information supplied by an affiliate.

Affiliates are responsible for any taxes or reporting obligations that may apply to their affiliate earnings.

12. Termination & Suspension

An affiliate may stop participating in the Affiliate Programme at any time.

TheHairxcential Limited may suspend or terminate an affiliate account where it reasonably believes that the affiliate has breached these Terms or has engaged in fraudulent, abusive, misleading or otherwise inappropriate activity.

Examples include:

• Fraudulent transactions.
• Manipulation of affiliate tracking.
• Misleading advertising.
• Misuse of TheHairxcential branding.
• Spam or abusive promotional activity.
• Conduct that damages the reputation of TheHairxcential Limited.

13. Intellectual Property

TheHairxcential name, logos, trademarks, product images, graphics, written content and other brand materials belong to or are licensed to TheHairxcential Limited or their respective owners.

Affiliates may only use promotional materials supplied or authorised by TheHairxcential Limited for legitimate Affiliate Programme purposes.

Permission to use such materials ends when affiliate participation ends, unless otherwise agreed in writing.

14. Liability

Participation in the Affiliate Programme does not guarantee any specific level of sales, income, traffic or commission.

Affiliates are responsible for their own promotional activities and for complying with applicable laws, advertising requirements and platform rules.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

15. Changes to These Terms

TheHairxcential Limited may update these Terms from time to time to reflect changes to the Affiliate Programme, business practices, technology or applicable legal requirements.

Updated Terms will be published on this page.

Continued participation in the Affiliate Programme after changes have been published may constitute acceptance of the updated Terms.

16. Governing Law

These Terms and your participation in the Affiliate Programme are governed by the laws of England and Wales, unless otherwise required by applicable law.

Subject to applicable law, disputes arising from or relating to these Terms shall be subject to the jurisdiction of the courts of England and Wales.
